Commercial Litigation
What is “Litigation”?
Simply defined it means the process of taking proceedings before the court so that a decision can be made.
It seldom is that simple. Knowing the law is only half the battle. What is more crucial for a client is receiving excellent commercial advice. Sometimes the best commercial decision is not to issue proceedings. That may sound strange coming from a firm of solicitors but an early settlement of a dispute without proceedings is often the best solution for a business. The key is knowing when to issue proceedings.
Our Litigation Department is headed by Partner Anis Waiz. We act for high net worth individuals, various lenders and corporate/institutional clients. Our aim is to provide clear commercial advice whilst adding value to any business. In addition to general litigation areas, our expertise relates to the following specialist matters:
- Commercial agreements and terms and conditions
- Property disputes (including defended claims for possession)
- Sale of goods claims and supply of goods and services
- Asset finance litigation
- Insolvency litigation (including claims against guarantors)
- Partnership disputes
- Professional negligence (including acting for lenders against professionals)
- Asset tracing (including claims arising from fraud)
- Claims before HM Land Registry arising from fraudulent mortgages
- Shareholder disputes
- Debt collection and recovery
